Color Incorporated Digital Imaging (“Color Inc,” “we,” “us,” or “our”) respects the privacy of our customers and is committed to protecting the personal information and customer content entrusted to us.
This Privacy Policy explains how we collect, use, disclose, and protect information when you visit our websites, create an account, place an order, upload images, use our ordering software or services, communicate with us, or otherwise interact with Color Inc.
By using Color Inc’s websites, ordering systems, products, or services, you acknowledge the practices described in this Privacy Policy.

4. Photographs, Images, and Customer Content
Customers retain their rights in photographs, images, artwork, designs, files, and other content submitted to Color Inc (“Customer Content”).
Uploading or transmitting Customer Content to Color Inc does not transfer ownership of that content to Color Inc.
Customers grant Color Inc the limited rights necessary to receive, store, process, reproduce, modify for production purposes, transmit, manufacture, print, package, and otherwise use Customer Content as reasonably necessary to provide the products and services requested by the customer.
Color Inc may also access Customer Content when reasonably necessary to provide customer service, technical support, troubleshoot production issues, investigate fraud or misuse, maintain system security, or comply with applicable law.
Color Inc will not use a customer’s photographs or other Customer Content in Color Inc advertising, promotional materials, social media, portfolio displays, trade-show materials, or other public marketing without the customer’s permission, except where otherwise authorized by a separate agreement or submission.
5. Images Containing Other Individuals
Color Inc primarily provides services to professional photographers, studios, schools, organizations, businesses, and other customers who may submit photographs depicting their own clients, students, athletes, families, employees, or other individuals.
The Color Inc customer submitting such content is responsible for having the rights, permissions, releases, and lawful authority necessary to submit the images and request the applicable products or services.
Color Inc processes such images on behalf of its customers for the purpose of providing requested printing, manufacturing, storage, fulfillment, and related services.
6. School, Sports, and Event Photography
Certain Color Inc services support school, sports, event, team, and volume photography.
These services may involve photographs and information relating to students or minors.
Color Inc does not obtain ownership rights in these photographs merely because they are submitted for printing or fulfillment.
Customers using Color Inc for school, sports, event, or youth photography are responsible for ensuring that their collection and submission of photographs and related information complies with applicable laws and any agreements or requirements applicable to their organization, school, league, client, or program.
Color Inc uses such information to provide the printing, manufacturing, fulfillment, customer service, technical, and related services requested by its customers.
7. Integrated Partners and Ordering Platforms
Color Inc may receive orders, images, customer information, shipping information, and other data through third-party platforms and integrations selected by our customers.
These may include photography sales platforms, ordering systems, gallery providers, school and sports photography platforms, and other integrated services.
Information received through an integrated partner may be used to manufacture, fulfill, ship, support, and administer the applicable order or service.
Third-party platforms operate under their own privacy policies and terms. Color Inc is not responsible for the privacy practices of independently operated third-party platforms.
8. Service Providers and Disclosure of Information
Color Inc may disclose information to trusted third parties that assist us in operating our business and providing services.
These providers may include:
Payment processors;
Cloud hosting and data-storage providers;
Website and technology providers;
Email and communications providers;

Color Inc may establish or modify retention periods for Customer Content and is not intended to serve as the customer’s permanent or primary image-storage service unless expressly agreed otherwise.
Customers should maintain independent backups of important photographs, artwork, and other files.
13. Data Security
Color Inc uses reasonable administrative, technical, physical, and organizational safeguards designed to protect personal information and Customer Content.
However, no internet transmission, electronic storage system, network, or security measure can be guaranteed to be completely secure.
Accordingly, Color Inc cannot guarantee the absolute security or availability of information transmitted to or maintained by our systems.
14. Privacy Rights
Depending upon where you reside, applicable law may provide certain rights concerning your personal information.
These may include rights to request access to, correction of, or deletion of certain personal information and rights concerning certain uses or disclosures of personal information.
Color Inc will process verified privacy requests as required by applicable law.

15. Children’s Privacy
Color Inc’s accounts and services are intended for photographers, businesses, organizations, and adult customers and are not directed toward children under 13.
Color Inc does not knowingly solicit children under 13 to create Color Inc customer accounts.
Because Color Inc provides professional photographic printing and fulfillment services, photographs submitted by our customers may depict children and minors. These photographs are treated as Customer Content and processed to provide services requested by our customers.
16. Third-Party Websites and Services
Color Inc websites and services may contain links to third-party websites, services, applications, or platforms.
Color Inc is not responsible for the privacy practices, security, content, or policies of independently operated third parties. Customers should review the privacy policies of third-party services they choose to use.
17. Changes to this Privacy Policy
Color Inc may update this Privacy Policy periodically to reflect changes in our products, services, technology, business practices, or legal requirements.
When material changes are made, we will provide notice as required by applicable law.
The effective date displayed at the beginning of this Privacy Policy identifies when the current version became effective.
